This Privacy Policy describes how Real Good Foods, LLC (“we”, “us”, or “our”), a leading frozen foods company that makes delicious, nutritious foods and handles the personal information that we collect and process through our site, realgoodfoods.com (“Site”). Please see specific state privacy notices including the California Notice at Collection and Privacy Policy below.

This Privacy Policy does not cover the privacy practices of third parties such as retailers and meal delivery services such as Instacart, and we encourage you to review those third party’s privacy practices.

PERSONAL INFORMATION WE COLLECT

Personal information you provide. Personal information collected includes:

  • Communications that we exchange, including when you contact us with questions, requests, reports, press inquiries, feedback, or otherwise communicate with us.
  • Contact information such as name, email address, phone, city, state, country, store product was purchased from, best by date, lot code, production line number and message when you engage with us to sign up for recipes or new product releases or when you report information concerning a particular product and the store where it was purchased.
  • Preferences such as communication preferences, preferences related to your use of our Services, demographic data, and any other preferences.
  • Other information that we may collect, which we will process as described in this Privacy Policy or as otherwise disclosed. 

Personal information collected from third party sources. We may collect personal information about you from third party sources such as public databases, advisors and agents, affiliates and subsidiaries, internet service providers, operating systems and platforms, data brokers and analytics providers, marketing companies, business partners, clients, social media platforms such as LinkedIn, YouTube, Pinterest, X, Instagram or Facebook, or other third parties or vendors. We may combine the personal information that we receive from you with personal information and other information that we obtain from other sources.

  • We may receive lead and prospect information, such as names, email addresses and contact information from third parties about companies or individuals who may be interested in engaging with us.
  • If you post information about us or engage with us on third party social media platforms, we may collect personal information about you from that third party platform or account. These third-party platforms and services control the information they collect and share about you. For information about how they may use and disclose your personal information, including any personal information you make public, please consult their respective privacy policies.

    Personal information collected automatically. We, third parties, our service providers, and our business partners may automatically collect information, including personal information, through the use of cookies, pixel tags, and other similar technologies such as:

    • Device data, such as your computer or mobile device operating system type and version number, manufacturer and model, browser type, screen resolution, domain names, date/time stamps, language, unique or online identifiers, internet service provider, clickstream data, IP address, the website you visited before and after browsing to our Site, general location information, and similar device and browsing information.
    • Activity and usage data, such as pages or screens viewed, time spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, log file information, duration of access, and other activity and usage information.

    HOW WE USE PERSONAL INFORMATION 

    We use personal information for the following purposes or as otherwise described: 

    • Services and support. To provide and operate our Site, communicate with you about your use of or interest in our Site or business, provide troubleshooting and technical support, respond to your inquiries, fulfill your requests, and for similar Site and support purposes.
    • Communications. To respond to questions and fulfill requests, to respond to press inquiries, to communicate about availability, the business, our products and services, events and other activities, to notify you of changes to our Site, and to otherwise communicate with you.
    • Analytics, measurement and improvement. To better understand how users access and use the Site and for other research and analytics purposes, such as to evaluate and improve our Site and business operations, to develop our Site and features, and for quality control and training purposes.
    • Marketing and advertising. To send you newsletters or other information about our Site and business operations, to offer sweepstakes and giveaways, and to manage, analyze, measure, and improve our outreach.
    • Research and development. To administer surveys and questionnaires and to allow you to participate in taste testing (e.g., testing new flavors and tasting new products), including for research and development purposes including for market research and to analyze and improve the Site, products, services and our business.
    • Career center. To post open positions and allow applicants to apply for positions online.
    • Security and protection of rights. To protect the Site and our business operations, to prevent and detect fraud, unauthorized activities and access, and other misuse, where we believe necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety or legal rights of any person or third party, or violations of our terms or this Privacy Policy.
    • Legal proceedings and obligations. To comply with the law and our legal obligations, to respond to legal process and related legal proceedings.
    • General business and operational support. Related to the administration of our general business, accounting, auditing, compliance, recordkeeping, and legal functions. 

    HOW WE DISCLOSE PERSONAL INFORMATION 

    We disclose personal information with the following parties, including: 

    • Our affiliates. We may disclose personal information to our affiliates, subsidiaries, and corporate group of companies, who will use and disclose personal information in accordance with this Privacy Policy.
    • Vendors and service providers. We may share personal information with entities and individuals that provide services on our behalf or help us operate the Site or our business (such as information technology, hosting, customer support, etc.).
    • Third-party retailers, store locators and delivery services. We may work with other third parties to sell or deliver our products or to locate stores near you. Links from our Site to a third party’s site are also governed by the third party’s privacy policy which we urge you to read carefully. 
    • Marketing, advertising, tracking and analytic providers. We and third-party marketing, advertising, and analytics providers collect personal information to implement and evaluate our Site and for advertising, analytics, measurement and marketing purposes. The personal information is collected through cookies and other tracking technologies via our Site as described below.
    • Sweepstakes and Giveaways. The personal information collected is described on the sweepstakes entry form and a separate privacy policy may apply. Please note that personal information collected during joint registrations may be collected under this Privacy Policy, a separate privacy policy or a third party’s privacy policy. Please note that in some jurisdictions, limited information about winners is permitted by law to be posted.
    • Professional advisors. We may share personal information with professional advisors, such as lawyers, investors, auditors, bankers and insurers in the course of the professional services that they render to us.
    • Authorities and others. We may share personal information with law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or as legally permitted for compliance and protection purposes.
    • Business transfers. We may share personal information with relevant participants in business transactions (or potential transactions) involving financing, a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets.
    • Others as permitted by applicable law. We may also disclose personal information to third parties to the extent permitted by applicable law and legal obligations. This may include regulators, government entities, and law enforcement as permitted by law or legal process. 

    COOKIES AND OTHER TRACKING MECHANISMS 

    We and other third-party providers use cookies and other similar tracking mechanisms to track your use of our Site. 

    • Cookies. Cookies are text files that websites store on a visitor’s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, helping us understand user activity and patterns, and facilitating analytics activities.

    You have the following choices with respect to your personal information: 

    • Promotional communications. You may opt out of marketing emails by following the opt-out or unsubscribe instructions at the bottom of the email, replying STOP to SMS or other messages or by contacting us as described below. You may continue to receive service-related and other non-marketing emails or communications.
    • Cookies. Most browsers let you remove and/or stop accepting cookies from the websites you visit. To do this, follow the instructions in your browser’s settings. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, however, you may not be able to use all functionality of the Site, and our Site may not work properly.     • Do Not Track. Some internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” or similar signals.
    • Decline to provide information. We need to collect personal information to provide certain services. If you do not provide the information requested, we may not be able to provide those services.

    This Notice at Collection and Privacy Policy provides information for California, Nebraska and Texas residents and describes our information practices under applicable privacy laws (“state privacy laws”). To the extent you are a resident of California, Nebraska and Texas, and we collect “personal information” or “personal data” under state privacy laws, the following applies. This section does not address or apply to our handling of personal information that is exempt under state privacy laws, such as publicly available information or deidentified or aggregated information. 

    Categories of Personal Information and Disclosed. We generally collect the following categories of personal information about California, Nebraska and Texas residents and may disclose personal information to the following third parties for a business or commercial purpose.  

    • Identifiers. Such as name, address, unique personal identifiers, email address, or other similar identifiers. We may disclose this information to advertising networks, internet service providers, data analytics providers, operating systems and platforms, social networks, data brokers, advisors and agents, regulators, government entities, and law enforcement, others with your permission or as permitted by law.
    • Customer Records. Such as account information and customer records that contain personal information, such as name, email address, phone, city, state, country, store product was purchased from, best by date, lot code, production line number and message, demographics and other characteristics or descriptions, and contact information. We may disclose this information to advertising networks, internet service providers, data analytics providers, operating systems and platforms, social networks, data brokers, advisors and agents, regulators, government entities, and law enforcement, others with your permission or as permitted by law. 
    • Commercial Information. Such as records of services purchased, obtained, or considered, or other purchasing or use histories or tendencies.
    • Location Data. Such as general location information about a particular individual or device.
    • Audio, Electronic, Visual, or Similar Information. Such as personal information collected via call recordings if you are interacting with us in a customer service capacity, if you call us on a recorded line, or attend recorded meetings or events and webinars. We may disclose this information to advertising networks, internet service providers, data analytics providers, operating systems and platforms, social networks, data brokers, advisors and agents, regulators, government entities, and law enforcement, others with your permission or as permitted by law.
    • Inferences. Such as inferences drawn from any of the information described in this Section about a consumer including inferences reflecting consumer preferences, characteristics, behaviors, attitudes, abilities, and aptitudes. We may disclose this information to advertising networks, internet service providers, data analytics providers, operating systems and platforms, social networks, data brokers, advisors and agents, regulators, government entities, and law enforcement, others with your permission or as permitted by law.
    • Internet or Other Electronic Network Activity Information. Such as browsing history, clickstream data, search history, and information regarding interactions with our Sites and Services, advertisements, or emails, including other usage data related to your use of any of our Services or other similar online services. We may disclose this information to advertising networks, internet service providers, data analytics providers, operating systems and platforms, social networks, data brokers, advisors and agents, regulators, government entities, and law enforcement, others with your permission or as permitted by law. 

    Sales, Sharing or Conducting Targeted Advertising with Personal Information. The California, Nebraska and Texas privacy laws define “sale” as disclosing or making available personal information to a third-party in exchange for monetary or other valuable consideration, and California privacy law defines “sharing” as disclosing or making available personal information to a third-party for purposes of cross-contextual behavioral advertising, and Texas and Nebraska law define “targeted advertising” as displaying to a consumer an advertisement that is selected based on personal data obtained from that consumer's activities over time and across nonaffiliated websites or online applications to predict the consumer's preferences or interests.  

    While we do not disclose personal information to third parties in exchange for monetary compensation, we may “sell” for valuable consideration, “share” and conduct “targeted advertising” with the following categories of personal information: identifiers; customer records; commercial information; general/precise location data; audio, electronic, visual, or similar information; inferences; and Internet and network activity information. We may disclose these categories to third-party advertising networks, analytics providers, and social networks for purposes of marketing and advertising and to improve and measure our ad campaigns. We do not sell, share or use sensitive personal information in targeted advertising nor do we sell or share personal information about individuals we know are under age sixteen (16). 

    Sources of Personal Information. We generally collect personal information from the following categories of sources: directly or indirectly from you; advertising networks, public databases, affiliates and subsidiaries; business partners; vendors and service providers; government entities; third-party websites and services; social networks; internet service providers; operating systems and platforms; marketing and data analytics providers or other third-party sources. 

    Purposes of Collection, Use, and Disclosure. We may collect, use, disclose, and otherwise process the above listed personal information for the following business or commercial purposes described above under How We Use Your Personal Information above (i.e., Services and support; Communications; Analytics, measurement and improvement; Marketing and advertising; Research and development; Career center; Security and protection of rights; Legal proceedings and obligations and General business and operational support), or as we otherwise provide notice or as directed or consented to by you. 

    Aggregated and/or de-identified information. We may use and disclose aggregate and other non-identifiable data related to our business and the Services for quality control, analytics, research, development, and other purposes. Where we use, disclose, or otherwise process de-identified data (data that is no longer reasonably linked or linkable to an identified or identifiable natural person, household, or personal or household device) we will maintain and use the information in deidentified form and not to attempt to reidentify the information, except in order to determine whether our deidentification processes are reasonable and adequate pursuant to applicable privacy laws. 

    Sensitive Personal Information. We do not collect, use, or disclose “sensitive personal information” beyond the purposes authorized by state privacy law. 

    Retention. We retain the personal information that we collect as reasonably necessary for the purposes described above or as otherwise disclosed to you at the time of collection. For example, we will retain your personal information as necessary to comply with our tax, accounting, and recordkeeping obligations, to provide you with the services you have requested, as well as an additional period of time as necessary to protect, defend, or establish our rights, defend against potential claims, and comply with our legal obligations. In some cases, rather than delete your personal information, we may deidentify or aggregate it and use it in compliance with state privacy law. 


    California, Nebraska and Texas Residents’ Rights. Under state privacy laws, California, Nebraska and Texas residents have the following rights (subject to certain limitations):  

    • To opt out of sales, sharing and targeted advertising. The right to opt-out of the sale, sharing, or targeted advertising using personal information. 
    • To limit certain uses and disclosures of sensitive personal information (or opt-in or opt-out). We use and disclose sensitive personal information for purposes authorized under state privacy laws; thus, this right is not applicable to California, Nebraska and Texas residents at this time.
    • To delete. The right to delete personal information subject to certain exceptions.
    • To know/access/portability. The right to know, access and/or transfer (port) personal information, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information.
    • To correct. The right to correct inaccurate personal information that we maintain about them. 
    • To appeal (Nebraska and Texas only). The right to appeal the denial of a request or the refusal to act.
    • Non-discrimination. The right not to be subject to discriminatory treatment for exercising their rights under applicable state privacy laws.   

    Submitting State Privacy Law Requests. California, Nebraska and Texas residents may exercise their state privacy rights as set forth below: 

    • Please submit requests to access/know, delete, and correct personal information by writing to Real Good Foods, LLC, Attn: Privacy Office, 525 W Crossroads Pkwy, Bolingbrook, IL 60440 or emailing ContactUs@RealGoodFoods.com.
    • When you submit a request, we will take steps to verify your identity and request by matching the information provided by you with the information we have in our records. In some cases, we may request additional information in order to verify your identity, or where necessary to process your request. If we are unable to verify your identity after a good faith attempt, we may deny the request and, if so, will explain the basis for denial.
    • You may also designate someone as an authorized agent to submit requests and act on your behalf. Authorized agents will be required to provide proof of their authorization, and we may also require the relevant consumer to directly verify the identity and the authority of the authorized agent.
    • In addition, if we detect that your browser or device is transmitting an opt out preference signal in California, Nebraska and Texas, such as the Global Privacy Control (“GPC”) signal, we will opt that specific browser or device out of cookies that result in a “sale”, “sharing” or “targeted advertising” using your personal information. If you come to our Site or use our services from a different device or from a different browser on the same device, you will need to opt out or use an opt out preference signal, for that browser and/or device as well.     SECURITY 

    We employ a number of measures designed to protect the personal information we collect. However, security risk is inherent in all Internet and information technologies, and we cannot guarantee the security of your personal information. There are also certain steps you can take to protect against unauthorized access to your personal information. For example, you should choose a strong password that is unique and do not reuse passwords across multiple sites and services or share your password with others. 

    INTERNATIONAL DATA TRANSFER 

    We are headquartered in the United States and may use service providers that operate in other countries. Your personal information may be transferred to the United States and other locations where privacy laws may not be as protective as those in your state, province, or country. 

    EXTERNAL LINKS 

    Our Site may contain links to third-party websites or features. Any access to and use of such linked websites or features is not governed by this Privacy Policy, but instead is governed by the privacy policies of those third parties. We are not responsible for the information practices of such third parties, including their collection of your personal information. We encourage you to review the privacy policies and terms for any third-party websites before proceeding to those websites or using those features. 

    CHILDREN/MINORS 

    We provide a general audience Site. The Site is not designed for minors, and we do not knowingly collect personal information from minors. 

    CHANGES TO THIS PRIVACY POLICY 

    We reserve the right to modify this Privacy Policy at any time. If we make changes to this Privacy Policy, we will notify you by updating the date on this Privacy Policy and posting it on the Site. If permitted by law, we will also provide notification of changes in another way that we believe is reasonably likely to reach you. Your continued use of the Site after the effective date of any modified Privacy Policy indicates your acceptance of the modified Privacy Policy.
